We collect identifiers (name, email, phone, address), commercial data (project details, purchase history), financial data (payment methods processed via Stripe/PayPal), internet activity (website interactions), geolocation (service address), and demographic details (date of birth for promotional eligibility).
3. Use of Information. Your data is used to: provide and improve services; process estimates and payments; send transactional and promotional communications; personalize digital dashboard experiences; conduct analytics; prevent fraud; and comply with legal obligations.
4. Transactional vs. Promotional Communications. 17. Estimates. Free estimates are generated using our algorithmic scoping tool and are valid for 30 days. Prices may adjust if hidden conditions exist (e.g., water damage, asbestos) or client requests change. Adjustments require written change orders.
18. Service Agreements. A detailed contract specifying scope, materials, timeline, and price must be signed before work begins. Verbal agreements are non-binding. All modifications must be documented in writing.
19. Payment Terms. Standard terms: 25% deposit, 25% midpoint, 25% substantial completion, 25% final walkthrough. Financing available via GreenSky (0% APR for 24 months on qualifying projects). Late payments accrue 1.5% monthly interest.
20. Cancellation Policy. You may cancel within 3 business days without penalty (FTC Cooling-Off Rule). Afterward, a fee of the lesser of 15% or $500 applies, plus costs for completed work and custom materials. Warranty plans are cancellable with pro-rated refunds.
21. Warranty. We provide a 10-year limited warranty on workmanship, excluding normal wear, acts of God, client negligence, or unauthorized modifications. Manufacturer warranties on materials vary. THIS WARRANTY REPLACES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
22. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, The Modern Home Craft IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Total liability shall not exceed the contract price paid for the specific project.
23. Indemnification. Client agrees to indemnify The Modern Home Craft against claims arising from: breach of Terms, provision of false information, third-party claims based on Client specifications, and undisclosed pre-existing site conditions.
24. Intellectual Property. All website content, software, and branding are property of The Modern Home Craft. Design concepts remain our IP until full payment is received, at which point a limited license for project use is granted.
25. Acceptable Use. Users may not: use the site unlawfully; provide false information; attempt unauthorized access; use bots to scrape data; transmit malicious code; or harass other users.
26. Permits & Compliance. The Modern Home Craft obtains all necessary building permits and handles inspections. Permit fees are included in estimates. Client must disclose HOA requirements prior to contract signing.
27. Force Majeure. We are not liable for delays caused by events beyond our control: natural disasters, pandemics, supply chain failures, labor strikes, or government mandates. We will notify clients promptly and adjust timelines accordingly.
28. Dispute Resolution. Disputes shall first go through our internal process. If unresolved, they will proceed to binding arbitration via the AAA in Seattle, WA. YOU WAIVE THE RIGHT TO A JURY TRIAL AND CLASS ACTION LAWSUITS.
29. Governing Law. These Terms are governed by the laws of USA, without regard to conflict of law principles. Exclusive jurisdiction resides in King County, USA courts for non-arbitrable matters.
